This Subscriber Agreement (the “Agreement”) is between you and World Pet Association, Inc. (“WPA,” “we,” “us”) and governs your subscription to petLENS Pulse (the “Service”). Your subscription renews automatically each year unless you cancel. You can cancel anytime from your account page; you keep access through the end of your paid year, and we do not give prorated refunds for the remaining term (see Section 5).

ANY DISPUTE BETWEEN YOU AND WPA, EXCEPT SMALL CLAIMS, IS SUBJECT TO A CLASS ACTION WAIVER AND MUST BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION. PLEASE READ SECTION 11 CAREFULLY BECAUSE IT AFFECTS YOUR RIGHTS.

1. Acceptance of This Agreement

By checking the box at checkout and completing your purchase, you agree to this Agreement and to the petLENS Privacy Policy. If you do not agree, do not subscribe.

You must be at least 18 and able to enter a binding contract. If you subscribe on behalf of a company, you confirm you have authority to bind that company, and “you” includes the company.

Notices. We may send notices to you by email to the address on your account or by posting them in the Service. You consent to receive notices, disclosures and other communications from us electronically, and you agree that electronic communications satisfy any legal requirement that they be in writing. Keep your email address current so you receive renewal reminders and other notices.

2. The Service

A petLENS Pulse subscription gives you online access to the WPA petLENS Pulse industry intelligence reports included in the plan you purchase, for the length of your subscription. Plans and add-ons are:

Free excerpt. The Executive Summary, Key Pulse Points, Audience and Methodology sections of The Total Species Report are published as a free excerpt that anyone, including media, can access without a subscription. All other report content requires a subscription.

Other petLENS products. petLENS Spotlight reports ($795 per quarterly report, purchased individually) and the petLENS Annual Report ($1,750 per year) are sold separately and are not included in a Pulse subscription.

We may change the format, schedule or features of the Service from time to time. If we make a change that materially reduces what you paid for, we will tell you in advance.

Availability. The Service may occasionally be unavailable, for example during maintenance, updates, outages, or events beyond our reasonable control. We will try to give advance notice of planned downtime. Temporary unavailability does not entitle you to a refund, though we may offer a credit at our discretion.

3. Subscription Term and Automatic Renewal

Term. Your subscription lasts one year, starting on the date of your purchase (your “Start Date”).

Renewal date. Your subscription renews on the anniversary of your Start Date each year (your “Renewal Date”). For example, a subscription purchased on March 14 renews every March 14.

Automatic renewal. UNLESS YOU CANCEL BEFORE YOUR RENEWAL DATE, YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW FOR ANOTHER ONE-YEAR TERM, AND WE WILL CHARGE THE THEN-CURRENT ANNUAL PRICE, PLUS APPLICABLE TAXES, TO THE PAYMENT METHOD ON FILE ON YOUR RENEWAL DATE. This continues each year until you cancel.

Renewal reminders. We will email you a reminder 30 days before each Renewal Date. The reminder will state the renewal date, the amount to be charged and how to cancel.

Consent. By checking the box at checkout, you consent to the automatic renewal terms above. We will send you a confirmation email after purchase that repeats these terms and explains how to cancel.

Complimentary subscriptions. WPA may offer complimentary access to eligible groups, as described in the applicable offer. Complimentary subscribers are bound by this Agreement. Complimentary access lasts for the offer period and only while you remain eligible. It never converts to a paid subscription, and you will not be charged unless you choose to purchase a plan or add-on.

4. Pricing and Payment

Price and billing. Prices for each plan and add-on are listed in Section 2 and at checkout. Each is billed annually, in full, at purchase and on each Renewal Date. Your renewal charge is the total of the plan and add-ons active on your account at that time.

Payment methods. We accept major credit and debit cards (including Visa, Mastercard, American Express and Discover) and the express checkout options Apple Pay and Google Pay, processed through WooPayments. You authorize us and our processor to store your payment method and charge it for each renewal. Keep your payment details current in your account.

Updated card details. If your card is replaced or its expiration date changes, our payment processor may receive updated card details from your card network or issuer. You authorize us to continue charging your card using the updated information.

Failed payments. If a renewal charge fails, we will email you and retry the charge up to 5 times over 7 days. If payment still cannot be collected, your access will be suspended until payment is made, and your subscription will be canceled if unpaid after 14 days.

Price changes. We may change the subscription price. Any change applies only at your next Renewal Date, never mid-term, and we will email you at least 30 days before it takes effect. If you do not want to pay the new price, cancel before your Renewal Date.

Taxes. Prices do not include taxes. You are responsible for any sales, use or similar taxes that apply, which we will calculate and show at checkout where required.

5. Cancellation and Refunds

How to cancel. You can cancel anytime online: log in, go to My Account > Subscriptions and select Cancel. Cancellation takes effect immediately for renewal purposes; no further charges will be made. You will receive an email confirming your cancellation. You may also cancel by emailing Info@wpamail.org. You never need to call us to cancel.

Access after canceling. Canceling turns off automatic renewal. You keep full access until the end of your current paid year, and your subscription then ends.

No prorated refunds. Except as stated below or required by law, payments are non-refundable and we do not give refunds or credits for the unused part of a subscription year.

Refund window. If you cancel within 7 days of your initial purchase, or within 7 days of an annual renewal charge, you may request a full refund, and your access will end when the refund is issued.

Other refunds. We may issue refunds or credits at our discretion, for example if the Service is unavailable for an extended period. Doing so once does not obligate us to do so again.

6. Your Account and Security

Each subscription is for one named individual. You must give accurate account information and keep your password confidential. You are responsible for activity on your account.

No login sharing. You may not share your login or let others access the Service through your account. If we reasonably believe an account is being shared, we may require a password reset, limit access or suspend or terminate the account under Section 9, without refund.

Tell us promptly at Info@wpamail.org if you believe your account has been accessed without permission.

7. Content Ownership and Permitted Use

Ownership. petLENS Pulse and all reports, data, charts, analysis and other content in the Service are owned by WPA or its licensors and are protected by copyright and other intellectual property laws. petLENS and petLENS Pulse are trademarks of WPA. Your subscription gives you a license to use the content; it does not transfer ownership.

What you may do. We grant you a limited, non-exclusive, non-transferable, revocable license, during your subscription, to access and read the content and use it for your own internal business purposes.

What you may not do. Unless we agree in writing, you may not:

• share, forward, post or distribute reports or downloads to anyone outside your subscription;
• resell, sublicense or publish the content, in whole or substantial part;
• remove copyright notices or attribution;
• scrape, bulk download or use automated tools to extract content; or
• use the content to build a competing product, or to train or feed artificial intelligence or machine learning models.

Accuracy. Content reflects WPA’s research and data sources at the time of publication and is provided for general informational purposes. It is not financial, investment or legal advice.

8. Privacy and Communications

Privacy. Our petLENS Privacy Policy explains how we collect and use information you provide at sign-up (such as name, company, job title, email, and billing address) and during use of the Service (such as log-ins and report views). Payment card details are processed by our payment processor and are not stored by WPA.

Account emails. By subscribing, you agree to receive transactional emails about your subscription, including purchase confirmations, new-issue notices, renewal reminders, payment issues, and changes to this Agreement. These are part of the Service and you cannot opt out of them while subscribed.

9. Suspension, Termination and Changes

Our right to suspend or terminate. We may suspend or terminate your access if you breach this Agreement (including login sharing or unauthorized distribution), fail to pay or use the Service unlawfully. If we terminate for breach, no refund is due. If we discontinue the Service entirely for reasons other than your breach, we will give you reasonable notice and a prorated refund for the unused part of your paid term.

Inactive complimentary accounts. We may close complimentary (unpaid) accounts that have not been logged in to for more than 12 months.

Changes to this Agreement. We may update this Agreement from time to time. We will post the updated version with a new “Last updated” date and, for material changes, email you at least 7 days before they take effect. Material changes apply starting at your next Renewal Date. If you do not agree, cancel before then. Continuing your subscription after that date means you accept the updated terms.

WPA staff, including customer service, cannot change or waive any part of this Agreement verbally or in writing, except through an update posted as described above or a written agreement signed by an authorized WPA officer.

10. Disclaimers and Limitation of Liability

Disclaimer. THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WPA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY FORECAST OR ESTIMATE WILL PROVE ACCURATE. ANY BUSINESS DECISIONS YOU MAKE BASED ON THE CONTENT ARE YOUR OWN.

Limitation of liability. TO THE FULLEST EXTENT PERMITTED BY LAW, WPA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE OR DATA, ARISING FROM OR RELATED TO THE SERVICE. WPA’S TOTAL LIABILITY FOR ANY CLAIM UNDER THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Governing Law, Disputes and General Terms

Governing law. This Agreement is governed by the laws of the State of California, without regard to conflict-of-law rules.

Disputes. Before filing any claim, you agree to contact us at info@wpamail.org and try to resolve the issue informally for at least 30 days. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Riverside County, California, and both parties consent to that jurisdiction.

General. This Agreement and the Privacy Policy are the entire agreement between you and WPA about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign this Agreement; we may assign it to an affiliate or a successor.

Survival. Sections that by their nature should continue after your subscription ends (including content ownership, permitted use restrictions, payment obligations, disclaimers, limitation of liability and disputes) survive termination.

Feedback and ideas. If you send us suggestions, ideas or feedback about the Service, you agree they are not confidential and that WPA may use them for any purpose without obligation or payment to you.
